and good monday morning, everyone. the suspected colorado gunman is back in court this morning. >> james holmes is expected to hear the long list of charges against him with all eyes, again, on his appearance, though shocking in the first court appearance next week. >> brandi hitt joins us from colorado with more. good morning, brandi. >> reporter: good morning. in a few heres, we'll hear about the charges of james holmes. >> monday july 30th. >> reporter: the prosecution is expected to lay down the hammer on 24-year-old james holmes ten days after colorado's movie theater massacre. he could face hundreds of charges, including 12 counts of first degree murder, 58 counts of attempted murder.

>> i don't care what his motive is. he knew what he was doing. i said, i want to see him. i want to see justice. >> reporter: ashley moser's stepmother says she'll be in the courtroom. not only did ashley lose her 6-year-old daughter in the shooting spree, she was shot several times and suffered a miscarriage. >> ashley's been through a lot. >> reporter: so have the victims' families. many buried their loved ones over the weekend. at the center of this investigation is a netbook that james sent to his psychiatrist. >> if a psychologist or psychiatrist feels that a patient they're treating may pose a threat, in most states they're obligated to do something. >> reporter: in this case, holmes' attorneys will say the

seizure of that notebook was a breach of confidentiality. they'll argue to get that notebook back in court today and that it also can't be used as evidence. >> you mentioned ashley moser's miscarriage. heart breaking. does that mean 13 charges will be filed now for murder? >> reporter: no, rob, not in colorado. we learned from a foerm prosecutor that in this state, homicide charges are not applied to those not born alive. in this case, it will still be 12 murder victims, not 13. but a tragedy for the family. at first, we thought she would be able to carry the baby. we learned over the weekend that the stress was just too much. >> a devastating turn. thank you, brandi. a developing story if the heartland. a series of bomb threats against walmart stores in two states.

three stores in kansas were temporarily close e ed and inspd by police. no bombs were found. overseas, syrians with fleeing their country in droves as a fierce battle continues to rage in aleppo. rebels celebrating after seizing a government tank. the opposition has reportedly taken over large section of the city. but syrian troops are pounding rebel conditions to regain control. mitt romney says the u.s. has a moral imperative to keep iran from getting nuclear weapons. the israelis have a right to defend themselves from the iranian threat. he wraps up his three-nation tour today with a wit to poland.

we're hearing can ditd comments from former vp dick cheney. he pulled no punches. frankly, the vice presidential vetting process wasn't handled well by john mccain's camp four years ago. >> i like governor palin. i've met her, i know her. she's an attractive candidate. based on her background, he had only been a governor for two years, i don't think she passed that test. >> being ready? >> being ready to take over. i think that was a mistake. >> no comment from palin's camp. romney will announce his choice this the coming weeks. we'll hear more from cheney on "good morning america." and there's new word on treatment being received by jesse jackson jr. he's been treated for depression

and gastrointestinal issues. protesters in anaheim are angry over the police shootings of two unarmed men. the protests culminated on tuesday night with the hundreds of protesters surging throughdown town. a giant dust storm engulfed phoenix yesterday. scientists say we can expect larger and more frequent storms like this and they're blaming it on climate change. that seems to be responsible for a lot of things right now. >> it's been a wild country across the country. time for a look at the weather across the country on your back to work monday morning.

welcome back, everybody. it's a homecoming of sorts for the stock market today. for the first time in almost three months, the dow jones industrial average opening above 13,000. it gained 188 points on friday because of enkourning news from europe and a government report showing the economy did not slow as much as had been feared. a problem with the new 787 dreamliner jet. debris from an engine started a grass fire over the weekend. five of the planes have been grounded. boeg says it still has confidence in its new jet. and watch for airfares to

come down soon, at least for a little wile. travel website farecompare cease drop in prices. the demand this summer seems to be down a little. airlines are likely to hold off on more fare hike attempts. >> that's refreshing. sfwlit will last for about 1 minutes. the take for "the dark knight" keeps rising at the box office. it was the number one film for a second weenend in a row. there was a 60% drop from the opening weekend. it took in $64 million. ice age, continental drift was the second place, just over 13 million bucks there. and the watch, getting slammed by the critics, still brought in about $13 million. it may have been a bitter weekend for starbucks' ceo howard schultz.

he lost $150 million on friday. he owns more than 30 million shares. >> coffee was on ice? bad joke this monday morning. and there's anger here in new york about a program that would lock up baby formula at hospitals all this the name of promoting breast-feeding for newborns. mayor michael bloomberg is backing the volunteer program that begins this september. baby formula will be available. mothers who receive it will get a lesson about the benefit about breast-feeding before they can tap the formula. >> good to know. the mayor getting involved in all kinds of issues over the last couple of months. an active mayor. and the action from the london games. including a supreme disappointment at the pool for team usa. and stranded 14 stories up.

highest scores of all in qualifying. there was a surprise as well. a heavy favorite, jordyn wieber, failed to qualify in the all-around competition. she was eliminated, as you can tell by that moment right there. >> some commentators think she was underscored and deserved to move on. no such problem for the men's team. they pulled away from france. final score, 98-71. the first lady there to cheer them on. the team is -- their next game is tomorrow against tunisia. >> let's check the all-important medal count at this point. china leads, 12 over all, half of them gold. the u.s. in second, 11 medals in all. italy in third with seven medals. >> kazakhstan has two. >> very nice. giving organizers headaches

updating our top stories now. suspected colorado shooter james holmes returns to court this morning and will hear the charges against him formally. he's not expected to enter a plea. it's unlikely he'll speak a t all. police in kansas are investigating the source of bomb threats made to three walmart stores. the dow opens above 13,000 this morning. the first time it's been that high since early may. and looking at today's weather, popup thunderstorms in the northeast. scattered storms across the south and midwest. windy with thunderstorms and flooding from phoenix to vegas. and finally from us this morning, as we watch the olympians compete and collect the medals, there's a whole group of superfans we don't usually ever see.
